Fee schedules

 

All options except option 5 have registration fees

You can make your own choice of which option you prefer but we highly recommend our options 2 or 5 as we pay District Court Costs and solicitor fees associated with enforcement of Court orders on these options. The Ministry of Justice has just put up their filing fees on all enforcement fees as of 1.7.11. See attached schedule. It will now cost a minimum of $568.80 to enforce any Tribunal or District Court order.

Please note during 2009 through 2011 the greater portion of all Tenancy Tribunal ordered debts were put back to the District Court under enforcement after we traced and approached the debtors to get them to pay voluntarily.

The reason we only offer 1 option on a contingency / "results only" basis is due to many creditors getting us to start work on tracing their debtors and then, when the only option is to litigate or enforce a debt, they fail to commit themselves to any action. We simply cannot work for nothing.... who does? Registration fees are required to be paid, prior to us starting any recovery action on any option that states a registration fee. Here's a sample of an order from the Manukau Tenancy Tribunal in Auckland with CIA collection costs included

All options cover the costs of tracing

OPTION 1 - Debt Registration only - no active debt collection 

Registration of Debt – no pro-active tracing – debt will also be lodged on

Tenancy Information New Zealand Ltd – www.tinz.net.nz and Veda Advantage

 $20 + GST registration per debt (i.e. per Court order)

25% + GST  commission of anything that is recovered if debtor decides to pay us to clear default

You will need date of births for individuals on this option. If you don't have them please choose another option.

OPTION 2 – on this option CIA pays all enforcement costs - full collection, tracing and enforcement
 

The most preferred option for C.I.A.

$250 + G.S.T. registration per debt or per debtor if you want us to actively pursue joint debtors. 

20% plus G.S.T. commission  of anything that is recovered 

We will cover the costs of one enforcement process if we need to take this course of action 

Current costs of enforcement for an order for examination amount to more than $569.00

(as of 1/7/11 order for exam $109, solicitor's document preparation $307, Solicitor's appearance at hearing $153).

So this is the best option in the light that 87% of all Tenancy Tribunals had to be enforced in 2009/2011

OPTION 4 – you pay 50% of enforcement costs if deemed necessary - full collection, tracing and enforcement

 $125 + G.S.T. registration fee which is payable to register the debt

30% plus G.S.T. commission of anything that is recovered

OPTION 5 –  Minimum Debt $800 -  RESULTS ONLY DEBT RECOVERY & ENFORCEMENT - full collection, tracing and enforcement

We will cover the costs of one enforcement process if we need to take this course of action

 50% Plus G.S.T. commission of anything that is recovered No registration fees on this option

On this option CIA reserves the right, not to enforce the debt via the District Court

OPTION 7 – Debts under $800  you pay ALL litigation & enforcement costs if deemed necessary - minimal tracing undertaken

 $30 + G.S.T. registration fee which is payable to register the debt 

 40% + G.S.T. commission of anything that is recovered
